A major turning point: the French Supreme Court has ruled that Airbnb can no longer benefit from the protective status of a mere host.
Why the change? The Court considers that the platform is not neutral. It actively involves itself in the host-guest relationship by imposing strict rules on listings and transactions, and by influencing user behaviour through tools such as the Superhost status.
The consequence? Airbnb loses its technical immunity and becomes jointly and severally liable for the content and the consequences of the listings published on its platform.
